Prevarication Or Preemptive Protection of Prisoners’ Privacy?

This just in from Beth:
“I nominate the lawyers who argued for the Bush Administration's position on the following matter for the straight-face argument award. The administration is worried about invading the privacy of "shadow prisoners" in secret prisons subjected to torture at the hands of our CIA?????
